FACILITY RULES

1. There is a 30-day sobriety requirement prior to admission into the Facility. If a member relapses and is released they will need to acquire an additional 30-days of sobriety in order to reenter. This rule is for the welfare of all Facility members and their sobriety.

2. There is a minimum requirement of a 90 day commitment.

3A.    All new members are required to attend a AA/NA/CA meeting every day until they start work, volunteering or school, to have a sponsor and home group within two weeks.

3B.   Once work, volunteering or school starts, all members are required to attend four AA/NA/CA meetings on a weekly basis, and be working on their recovery – progressing through the 12 Steps because sobriety is our primary purpose. Failure to obtain a sponsor within 14 days, a home group or not attend the minimum number of meetings for any reason will result in the following and may be grounds for dismissal:

1st Violation:  Community service – two (2) hours
2nd Violation:  Behavioral Contract

Note:  Members are required to report the names of the meetings attended, days and times during the Sunday facility meeting.
Note:  Members enrolled in an Intensive Outpatient Program (IOP) will be permitted to count that towards one of their required meetings.

4.  Any Facility member who is found to be using any narcotics, synthetics or alcohol will be released immediately.  Any member who has knowledge of another member’s relapse and withholds this information from the Facility could be removed.  If you provide urine or tamper with urine or have knowledge or other’s tampering with a specimen will be grounds for removal.

Types of using may include:

a) Taking any medication not prescribed to the individual by a physician or otherwise not approved by the Facility:
b) Taking any prescription narcotic medication (NO EXCEPTIONS)
c) Not taking medicine as prescribed and required by a physician
d) Taking any over-the-counter medication or nutritional supplements that can produce a false positive on a drug test, such as Kava, Kratom, ephedrine-based medication or dextromethorphan which is the active ingredient in medications like Mucinex, Robitussin or Nyquil.  Each member is responsible for checking the ingredient content of items before putting it in the body.  If there is ANY question, do not take it and ask an ATP staff person.

5.  Drug/Alcohol testing may be required from any member at any time and without notice. Failure to submit to testing for any reason will be viewed as an admission of relapse that will require immediate release and removal of the member.  Urine specimen collection shall be performed by a male ATP staff using a direct observation collection method.

6.  In order to obtain membership at ATP, a full month membership fee of $700.00 and a $200.00 security fee are required. The membership fee is due before admission.  Future membership fees will be due on the date of the month that you arrived. (Example:  Arrival date – 1/7. The fee will be due again on 2/7).  The fee is due on that date and considered late after the third day. There is a $10.00 a day late fee for each day thereafter.   All payments may be made by check or money order payable to Austin Turning Point or by credit/debit card (VISA, MasterCard, Discover and American Express).   We do not accept cash.

7.  All members are required to have a minimum of 20 hours of verifiable employment, be enrolled in nine hours of school or have secured a 20 hour volunteer position within two weeks of their move-in date.  Members are also required to be out of the Facility from 10:00 a.m. – 2:00 p.m., looking for employment or volunteer opportunities during the week Monday through Friday. Once a job, volunteer commitment or school starts this is no longer in effect.  If found in the Facility during those hours, two hours of *community service will be assigned and a 9:00 p.m. curfew will be in effect for seven days. This applies to all members regardless of their personal or financial situation. If after two weeks the above has not been accomplished, you may be required to attend a noon meeting Monday – Friday in addition to the four weekly required meetings.  An exception to the 10 – 2 rule can be made for harsh weather conditions. Check with the Facility manager.

8A. In order to have an overnight pass approved the following requirements must be met:

a) Have been a member for at least 30 days
b) Have turned in a properly completed overnight pass request to the Facility manager and obtained written approval (email/text/hand written) 48 hours prior to leaving
c) Leave a contact number
d) Make sure chore(s) is covered and
e) Have no outstanding fines, membership fees or community service
f)  Each member will be drug tested upon return.  Failure to comply will result in their release or non-renewal notice.

8B.   After 60 days, any member may stay out two nights a week and also meet B – E of the above requirements.  Any extended overnight stays are a Facility decision and for special circumstances only.

8C.      After six months, any requests to stay out additional time will be handled on a case by case basis.

9.  Facility meetings are mandatory!    

The only exception for missing meetings is an approved and documentable work commitment and/or one (1) Facility meeting a month for an approved overnight stay.

Being late will result in:

1st Violation:  Verbal warning
2nd Violation:  *Community service – one hour
3rd Violation:  Behavioral Contract

Missing a Facility meeting will result in:

1st Violation:  *Community service – one hour
2nd Violation:  Behavioral Contract

10.  Disruptive behavior is grounds for release and described below:
a) Any physical or verbally anti-social behavior
b) Stealing (eating someone else’s food or using their toiletries is considered stealing)
c) Lying
d) Being in another members room without permission
e) Constantly complaining or bringing negativity into the Facility

11.  Weekly chore lists will be posted at the beginning of each week. As a Facility member you are expected to do your chores daily. Failure to comply will result in:

1st Violation:  Verbal warning
2nd Violation:  *Community service – one hour
3rd Violation:  Behavioral Contract

12.  Be clean!  Bedroom needs to be immaculate! No leaving dishes in the sink, leaving personal items in living room or common areas (kitchen, bath, etc.), not bathing, not changing bed sheets weekly or being unsanitary in any way are all offenses.  Failure to comply will result in:

1st Violation:  Verbal warning
2nd Violation:  *Community service – one hour
3rd Violation:  Behavioral Contract  

13.  Members are responsible for purchasing and cooking their own food, supplying their own personal hygiene items (toothbrush, toothpaste, bath soap, shampoo, razors, shave cream, etc.) and for any other items for health issues (prescriptions, medical care, etc). The Facility will supply the following items: laundry soap, dish soap, dishwasher soap, toilet paper, paper towels and coffee -98oz/monthly.

14.  No active alcoholics or addicts are allowed on premises – no exceptions!!  Any visitors on premises may be subject to alcohol or drug testing at any time.  

15.  If you are the last to leave the Facility, you are responsible for locking both the front and back door.  Failure to lock up will result in the following:

1st Violation:  Verbal warning
2nd Violation:  *Community service – one hour
3rd Violation:  Behavioral Contract

16.  The living room television is to be off between the hours of 11:00 p.m. to 7:00 a.m., Sun.-Thurs.  This is considered QUIET TIME.  Please respect your Facility members.  Failure to comply or excessive noise will result in:

1st Violation:  Verbal warning
2nd Violation:  *Community service – one hour
3rd Violation:  Behavioral Contract

17A. There is a 10:00 p.m. curfew for all members in their 30-day probationary period.  After a member reaches their 30-day probationary period, the curfew changes to Sunday-Thursday 11:00 p.m. and Friday/Saturday is midnight, unless otherwise approved by the Facility. (No nighttime jobs allowed).  Being late for curfew will result in:

1st Violation:  Verbal warning
2nd Violation: *Community service – one hour
3rd Violation:  Behavioral Contract with an additional seven days of 10:00 p.m. curfew

17B.      If a member stays out all night without permission, they may be asked to leave the Facility Immediately.  A UA/Breathalyzer test will be done immediately. If they are allowed to stay, a Behavioral Contract will be issued and a 9:00 p.m. curfew will be in effect for 30 days

18.  Members are responsible for doing their own laundry. Each Facility must use their assigned washer and dryer.  Laundry must be done and put up immediately. If you are not going to be there to get your laundry out, please do not start it.  Other members have the right to move your laundry to a clean out of the way location if you are unavailable.

19.  All Facility members are responsible for ensuring anonymity and friendliness within the neighborhood. All Facility business remains within the Facility and we do not air our business with the neighbors. Ensuring anonymity means protecting each other’s personal status as an alcoholic or addict (i.e.: telling neighbors or visitors this is a sober Facility).

20.  No soliciting in the neighborhood for any reason or loitering in front of the Facility.

21.  Members are allowed to have a vehicle with management consent.  The member must provide copies of a current driver’s license, registration and insurance with-in three days of their move-in date.  If this is not provided we have the right to have the vehicle towed. The Facility shall be given access to inspect the vehicle’s interior or trunk upon request at any time.

22.  Do not park in front of neighbor’s house. There will be no broken down cars or vehicles allowed on premises unless approved by the Facility for immediate repair purposes only.  Please ask Facility manager for approved parking area.

23.  Grocery shopping should be done on a weekly basis vs. a monthly basis due to limited shelf and refrigerator space.  If any other member’s food is eaten without their permission it will be considered stealing (see 9b).

24.  After 11:00pm, kitchen is closed for cooking, including microwave. If you are hungry eat cereal, sandwich or fruit.  Failure to comply will result in:

1st Violation:  Verbal warning
2nd Violation: *Community service – one hour
3rd Violation:  Behavioral Contract

25.  There is no burning of candles or incense as well as no smoking, e smoking or vaping anywhere inside the Facility or in front of the Facility. Dipping is allowed with proper containers (i.e.:  plastic bottles with lids – not Facility dishes) and not to be left out.  Failure to comply with dipping protocol will result in loss of inside privileges for 30 days.  In addition, the following will be given for violation of either the no smoking, e smoking or vaping and the dipping containers being left out:

1st Violation:  Verbal warning
2nd Violation: *Community service – one hour
3rd Violation:  Behavioral Contract

26.  All rooms are to be assigned by Austin Turning Point staff.  If you want to change rooms you must first check with staff for approval.  ATP has the right to assign a member to another living space or another property owned or leased by ATP at any time and without notice.

1st Violation:  Verbal warning
2nd Violation: *Community service – one hour
3rd Violation:  Behavioral Contract

27.  No visitors are allowed in any rooms for any reason with the exception of new client tours by staff or on move in day.

1st Violation:  1st Violation: Behavioral contract which includes an early curfew of 10:00 p.m. curfew. If on 12 a.m. curfew and 9:00 p.m. if on a 10:00 p.m. curfew. Duration to be specified in contract.

28.  No weapons of any kind are allowed on premises. If a weapon is found in a member’s possession, the member may be asked to leave immediately and without refund.

1st Violation:  1st Violation: Behavioral contract which includes an early curfew of 10:00 p.m. curfew. If on 12 a.m. curfew and 9:00 p.m. if on a 10:00 p.m. curfew. Duration to be specified in contract.

29.  Surfing pornography or distasteful websites on Facility computer is not allowed.  Anyone caught doing this will have the following consequences:

1st Violation:  Verbal warning and loss of access to Facility computer for 30 days
2nd Violation:*Community service – one hour and loss of access to Facility computer for 30 days
3rd Violation:  Behavioral Contract and loss of access to Facility computer for 30 days

30.  No desktop computers, furniture, Electronics (toasters, T.V’s, grills, etc.) are permitted.  Gaming consoles, laptops, and iPads are allowed but at your own risk. ATP is not responsible for keeping of such items.  ATP staff may search browser history of related equipment to ensure house standards are upheld.

31.   Member must notify ATP staff within 24 hours of any prescribed medication changes.

32.  Once a member departs, all mail will be returned to sender.  Please put in a change of address.

33.  ATP is not responsible for any member’s stolen items.

34.  Breach in contract for any reason (i.e.: relapse on alcohol or drugs, two weeks late on membership fees, excessive rule infractions, stealing, disruptive behavior, etc…) will result in loss of all monies paid for membership fees and any refundable security fee and will result In the immediate removal from property.  If the member fails to immediately leave the Facility, the Facility will be entitled to $5,000.00 in liquidated damages for the disruption to business operations and the threats posed to the sobriety and mental well-being of the other members remaining on site.  Any items left in the Facility will be removed from the Facility and discarded after 5 days.    

35.  The security fee for membership will be returned to original payee one week after member has left the premises and has met the following requirements:

a) Successfully completed a ninety day program commitment at ATP
b) A thirty day notice must have been given.
c) All ATP items (i.e.: linens, mattress, comforter, pillow, etc) are accounted for and in good shape (taking into consideration normal wear and tear); and
d) Room has been cleaned                                                

36.  Members that have had financial support to pay membership fee(s) and breaches contract for any reason will have their family or payee contacted by ATP, letting them know that you are no longer under our care.

37.  This Agreement is not a lease and does not create a landlord-tenant relationship of any kind.  Member expressly acknowledges that this Agreement does not create any of the rights afforded to residential tenants pursuant to Chapter 92, Texas Property Code.  Member expressly acknowledges that:

a) Fees do not constitute rent; and
b) If a member remains on ATP property without consent of ATP, and after receiving oral or written notice to depart, member may be arrested for criminal trespass.
c) The Facility may change the locks without notice for any violation of this Agreement.  Any member must contact Facility staff to seek a new key or code.
d) The Facility may remove any member’s non-exempt property for violation of the terms of this Agreement.                     

38.  The rules are suggested guidelines and subject to change.  ATP and its employees reserve the right at any time to:

a) Modify the consequences and can move straight to a behavioral contract and/or dismissal as necessary and appropriate.
b) Revoke the membership of any member who is deemed a threat to the sobriety and recovery of members at their sole discretion. Revocation of membership will result in immediate removal from the property at the request of ATP and/or its employees or contract labor.

39.  Abe Hernandez has full authority over the Facility as needed.
